また新しく Sony BMG の Rootkit を利用するバックドア・プログラムが見つかったそうです。
以前に発見された物と同じように添付ファイルを実行するとバックドア・プログラムの $SYS$DRV.EXE がウィンドウズ・システム・フォルダにがコピーされるそうです。
Backdoor.Win32.Breplibot.b という名前が付けられている所を見るとボットかな？

ニューヨーク州司法長官も乗り出したようです。

New York's Attorney General has turned his attention to Sony BMG's copyright-protection fiasco

"It is unacceptable that more than three weeks after this serious vulnerability was revealed, these same CDs are still on shelves, during the busiest shopping days of the year," Spitzer said in a written statement. "I strongly urge all retailers to heed the warnings issued about these products, pull them from distribution immediately, and ship them back to Sony."

ニューヨーク州司法長官 Eliot Spitzer は「この深刻な問題が明らかになってから３週間以上にもなるのにまだＣＤが販売されているのは受け入れられない」と小売業者にこれらのＣＤを引き上げ、ソニーに送り返すように強く警告したそうです。

Spitzer's consumer warning came days after Texas Attorney General Abbott filed the suit against the company in Travis County, Texas. Abbott is seeking fines against Sony BMG of $100,000 per violation. A spokesman for Spitzer's office in New York City declined to comment on the attorney general's plans beyond the consumer warning, other than to say the office is "looking into" the matter.

テキサス州は１つの違反に付き $100,000 を求めて提訴しているが、ニューヨーク州は「この問題を調査している」という以上のコメントを控えています。

In April, Spitzer's office had brought suit against Intermix Media, a Los Angeles-based firm. The suit followed a six-month investigation that culminated in allegations that Intermix had installed advertising software on home computers without having given those consumers ample notice. Intermix agreed to settle the suit and was required to pay $7.5 million. The company also had to accept a ban on the distribution of adware programs in the future.

４月に Spitzer は Intermix Media に消費者に十分に知らせる事なく広告ソフトをインストールしたとして訴え、$7.5 million と将来広告ソフトを配布しないと受け入れさせたという事です。
これは期待できるかも知れません。

また、一番売り上げの上がる時期にＣＤを引き上げられるアーティストサイドからも不満の声が上がってきているようです。

全ての人に迷惑を掛けてでも自分たちの権利は守られるべきだとでも思っているのでしょうか？

EULA (End User License Agreement) に同意しなくてもドライバがインストールされてしまうそうです。

今の所 MediaMax も問題にして訴えているのは EFF (Electronic Frontier Foundation, 電子フロンティア財団) だけだと思いますが、MediaMax にも問題があると思います。

EFF は Tor の開発の為の資金を使い果たしてしまったそうです。

EFF (Electronic Frontier Foundation, 電子フロンティア財団) はソニーに訴訟を起こしたりしてがんばっていますが、Tor の開発をサポートしている団体でもあります。
それで、Tor の開発の為の資金を先月使い果たしてしまったそうです。
Tor の開発メンバーは資金を得る案を模索中の様ではありますが、Tor の開発が止まってしまうのかな？

ソニーから訴訟で得た金を Tor の開発に回して貰いたいなと思ったんですが、ちょっと間に合わないですね。

Oregon's Department of Justice has "opened an investigation" into this tactic in response to complaints e-mailed to the agency's consumer inbox. If the state decides to sue Sony BMG, it will follow the state of Texas and the non-profit Electronic Frontier Foundation, which sued the music label separately last week. Texas says the hidden code violates the state's spyware law, and the EFF says the company violated consumer protection laws. Other class-action suits are pending, and the Italian government is contemplating a criminal case of its own.

オレゴン州司法省は消費者からの苦情に応じ、Sony BMG（のXCP）の調査を始めた。
もし、Sony BMG を提訴することを決定すれば、テキサス州、EFF に続くことになる。
他の集団訴訟もペンディング中で、また、イタリア政府は刑事告訴することを検討してる。

New Windows AntiSpyware released. Remove the rootkit!

A new beta for Windows AntiSpyware, soon to be renamed Windows Defender, was released yesterday. Microsoft recommends that anyone using the current version of Windows Antispyware should upgrade to the latest build.

Changes in the new beta are very subtle, with one exception. This release supports the removal of the Sony DRM rootkit. The December release of the Malicious Software Removal Tool will also remove the rootkit. We knew this was coming!

Sony BMG の２つの DRM 違い。

Sony BMG の DRM には First4Internet の XCP と Suncomm の Mediamax があるのですが、色々な問題が一気に出て、展開が早いので分かり難いのですが、２つの違いを表にまとめたブログ（英語）がありましたので紹介しておきます。

Sony BMG の DRM, SunnComm MediaMax にパッチが出されたそうです。

以前の記事で 紹介しましたが、Sony BMG の DRM, SunnComm MediaMax はスパイウェアのような振る舞いをすると問題になっていて、そのアンインストーラにはもう一つの DRM, XCP のアンインストーラと同じセキュリティホールを開けると問題になっていたんですが、そのパッチが出されたそうです。

SunnComm Technologies, a company that provides copy-protection technology for some Sony BMG CDs, said Monday it had issued a patch for a serious security flaw in its uninstallation program.

問題のあるアンインストーラを使った人は２２３人だそうです。

それで、新しく出されたパッチの信頼性はどうなんでしょう？
私には分かりませんが、個人的には信用できないので Microsoft 等で早く対応して貰いたいと思います。

以前の記事でも少し触れましたが、Sony BMG の Rootkit DRM は LAME というオープンソースのコードを流用していると指摘されています。
それで、LAME コミュニティから Sony BMG に公開質問状がだされました。

LAME コミュニティとしては今の所法的な事は考えていないそうですが、どういう事なのか回答が欲しいということです。

著作権、著作権と叫んで自分の著作権を守るために客のコンピュータにマルウェアをインストールして、そのマルウェアが他人の著作権を侵害しているのでは盗人猛々しいにも程がある。
Sony BMG は社会的に責任のある企業として回答する義務があると思います。

The Electronic Frontier Foundation (EFF), along with two leading national class action law firms, today filed a lawsuit against Sony BMG, demanding that the company repair the damage done by the First4Internet XCP and SunnComm MediaMax software it included on over 24 million music CDs.

EFF が Sony BMG に対して集団訴訟を起こしました。
First4Internet XCP だけでなく SunnComm MediaMax も対象にしているので、２千４百万枚以上のＣＤが対象になるようです。
Rootkit だけを問題にしているのではなく、スパイウェアも問題にしているという事ですね。

Texas Attorney General Greg Abbott announced Monday that he has filed suit against Sony BMG over the use of illegal spyware in its copy-protection mechanism that gained national attention earlier this month.

テキサス州司法長官が Sony BMG が違法なスパイウェアを使ったとして提訴したそうです。

Under Texas' Consumer Protection Against Computer Spyware Act of 2005, Abbott is seeking civil penalties of $100,000 for each violation of the law, attorneys' fees and investigative costs.

テキサス州のスパイウェアに対する消費者保護法で各違法行為につき $100,000 を求めているそうです。

テキサス州でどれくらい販売されたのか分かりませんが、凄い金額になりそうですね。

なんかこっちまで疲れてきました・・・

Sony BMG の最初の Rootkit アンインストーラでセキュリティ・ホールが指摘されていましたが、それを利用したサイトが幾つか見つかっているようです。
今の所、悪戯のようなサイトだけのようですが・・・

でも色々な所で言われていますが、下の記事に書いてあるように日本の感染が一番多くて米国の２倍近くあるなら輸入盤以外にも似たようなマルウェアがインストールされているような気がします。
ハッキリとさせるべきだと思います。
